These terms
These terms are an agreement between you and BVT Global Services (“BEVIEL”, “we”, “us”), registered at Santiago Surco, Lima 15054, Peru. They govern your use of BEVIEL Cloud, the BEVIEL desktop application, the BEVIEL Gateway and this website — together, the Service.
You accept them by creating an account or by using the Service. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it, and “you” means that organisation.
Our Privacy Policy explains what we do with personal data and forms part of this agreement.
Definitions
- Your Content — anything you provide to or create with the Service: source code, prompts, instructions, project files, documents, configuration, and the contents of any repository or workspace you connect.
- Output — the code, text, plans, reviews and other material the Service generates in response to Your Content.
- Model Provider — a third party that runs an AI model, whether reached with your own credentials or through BEVIEL-managed inference.
- Workspace — the container that holds your projects. An account is an identity; a workspace is where work happens; a plan is a subscription. They are three separate things and this agreement treats them separately.
Your account
You need an account to use BEVIEL Cloud. You must give accurate registration details, keep your credentials secure, and tell us promptly at security@beviel.com if you believe your account has been accessed by someone else. You are responsible for activity under your account.
You must be at least 16 years old, or the age of digital consent where you live if that is higher. The Service is built for professional software development and is not directed at children.
The Service is offered to customers in any country. During early access, self-serve registration is by invitation: creating an account needs an invitation code we have sent you, and we may stop accepting a code at any time.
If your account is created for you by an organisation — an employer, or a workspace administrator who invited you — that organisation administers it, can see the workspaces it owns, and can remove your access.
Plans, early access and fees
Free is available now, at no charge, to anyone who can register (see Your account). We may apply reasonable usage limits to it, and we will publish those limits rather than enforce them silently.
Starter, Pro and Team are in early access and cannot currently be bought. Their prices are published on our pricing page, and a published price is what we expect to charge — not a charge. Choosing one of these plans records your interest and holds your place in the queue. No payment method is taken, no fee is due, and no subscription starts. If we later offer these plans for sale we will publish the terms of sale first, and you will have to choose to buy — nothing converts automatically.
Enterprise is agreed in a separate written contract. If that contract conflicts with these terms, it prevails.
Paid-plan terms — billing period, taxes, renewal, refunds and cancellation — are not written yet. A price on the pricing page is not one of these terms and does not stand in for them.
They will be added here, and you will be asked to accept them, before any plan can be purchased. No clause in this document authorises us to charge you.
Every price and fee we publish is in US dollars (USD), whatever country you are in.
Model usage is separate from any plan fee. Where you use your own provider credentials, that provider bills you directly and we never see or handle the charge. See Model providers.
Your content and who owns it
Your Content is yours. We claim no ownership of it. As between you and us, you also own the Output generated from it, to the extent it can be owned at all — see Generated output.
You grant us a limited, non-exclusive licence to host, copy, transmit, display and process Your Content only as needed to operate the Service for you: running the work you ask for, sending prompts to the Model Provider you selected, storing your projects, backing them up, and investigating a problem you report.
We do not use Your Content or your Output to train AI models, and we do not sell it or share it for advertising. If we ever want to use it for anything beyond operating the Service, we will ask first and it will be opt-in.
You are responsible for having the rights to the content you bring — including any third-party code, licences and data you introduce into a workspace.
Model providers
BEVIEL does not train or run its own foundation models. It routes your work to a model you choose, by one of two paths, and the difference between them matters:
- Your own credentials. You connect your own provider account, or a model running on your own machine. Prompts, code and context go to that provider under your agreement with them, governed by their terms and their privacy policy, and they bill you directly. We are not a party to that relationship and cannot vary it.
- BEVIEL-managed inference. Your work is sent through the BEVIEL Gateway to a provider we hold the relationship with. We remain responsible to you for that path, and the providers behind it act as our sub-processors — they are listed in the Privacy Policy.
A local model — one running on hardware you control — sends nothing to a third party at all.
Whichever path you use, we show you which model handled a request. We may change or withdraw which models are available, including because a provider withdraws one, and we will not pretend a model is available when it is not.
Acceptable use
You must not use the Service to:
- break the law, infringe someone’s rights, or help someone else do either;
- build or distribute malware, ransomware, or tooling whose purpose is unauthorised access to systems you have no permission to touch;
- attack, overload, probe or circumvent the Service, its rate limits, its sandboxing or its access controls — including by using it to reach another customer’s data;
- resell the Service, share one account across a team to avoid seat charges, or use it to build a directly competing product;
- process personal data you have no lawful basis to process, or upload special-category data into a workspace without appropriate safeguards.
Security research on your own workspace is welcome. Report anything you find to security@beviel.com; do not test against other customers.
Generated output
Output is a draft for your review, not a finished product. AI-generated code can be wrong, insecure, subtly broken, or confidently incorrect — including when tests pass and when the Service reports success.
You are responsible for reviewing, testing and securing anything you ship. Do not deploy Output to production, or rely on it where failure causes harm, without your own verification.
Output is not legal, financial, medical or professional advice, and a verification step reported by the Service is evidence about a check that ran — not a warranty that the software is correct.
Output is not unique to you. The same or similar Output may be generated for other users from similar input, and we make no claim that Output is original or that it can be protected by copyright. It may resemble existing code; where a licence attaches to that code, complying with it is your responsibility.
Availability and change
We aim to keep the Service available and will give reasonable notice of planned maintenance, but the Service is provided without an uptime commitment unless one is agreed in writing on an Enterprise contract.
We develop the Service continuously and may add, change or remove features. If we remove something you depend on, or make a change that materially reduces what your plan provides, we will tell account holders before it takes effect where we reasonably can.
Early-access features may be incomplete, may change without notice, and may be withdrawn.
Our intellectual property
The Service itself — the platform, its interfaces, the BEVIEL name and logo, and everything we provide other than Your Content and your Output — belongs to us or our licensors. These terms grant you a limited, revocable, non-transferable right to use the Service, and nothing more.
You may not copy, reverse-engineer or create derivative works of the Service except where that restriction is unenforceable by law, and you may not remove our attribution or licence notices.
If you send us feedback or suggestions, we may use them without obligation to you. We will not ask you for your code in order to act on feedback about a bug.
Confidentiality
Your Content is confidential to you. We restrict access to it to the people who need it to run the Service or to answer a support request you raised, they are bound by confidentiality obligations, and access is logged.
We will not disclose Your Content except as described in the Privacy Policy, or where we are legally compelled to — in which case we will tell you unless the law forbids it.
Suspension and termination
You can stop using the Service and delete your account at any time. On deletion we remove your workspaces and their contents in line with the retention periods in the Privacy Policy. Export your work first — after the retention window it cannot be recovered.
We may suspend or terminate your access if you materially breach these terms, if your use puts the Service or other customers at risk, or if we are required to by law. Except where the risk is immediate, we will tell you what the problem is and give you a reasonable chance to fix it.
If we discontinue the Service entirely, we will give at least 30 days’ notice and provide a way to export your content.
Sections that by their nature should survive termination — ownership, confidentiality, warranties, liability, indemnity and governing law — do.
Warranties
We provide the Service with reasonable skill and care. Beyond that, and to the fullest extent the law allows, the Service is provided “as is” and we disclaim all other warranties, express or implied — including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that Output will be accurate, secure or fit for your purpose.
Nothing here excludes a warranty or right that cannot lawfully be excluded, and consumers keep their statutory rights.
Limitation of liability
Neither party excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, and to the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit, revenue, goodwill, business or anticipated savings, or for loss or corruption of data or code where you have not kept your own backups.
Our total aggregate liability arising from the Service in any twelve month period is limited to the greater of the fees you paid us in that period and US$100. While no plan can be purchased, the fees paid figure is nil, and the floor is what applies until one does.
Indemnity
You will defend and indemnify us against third-party claims arising from Your Content, from your use of the Service in breach of these terms, or from your deployment of Output — provided we notify you promptly, let you control the defence, and cooperate reasonably.
Changes to these terms
We may update these terms. For material changes we will give account holders at least 30 days’ notice by email or in the product before they take effect, and the version number and date at the top of this page will change.
If you do not accept a change, you may stop using the Service and delete your account before it takes effect. Continuing to use the Service after that date means you accept the new version.
Governing law
These terms are governed by the laws of Peru, and the courts of Lima, Peru have exclusive jurisdiction over any dispute — without depriving a consumer of the protection of the mandatory law of the country where they live.
If any provision is held unenforceable, the rest continues in force. A delay in enforcing a right is not a waiver of it.
